ChapterIGeneralProvisions

Article1TheseRegulationsareformulatedwithaviewtopreventingconstr

uctionprojectsfromgeneratingnewpollutionanddamagingtheecologicalenvir

onment.

Article2TheseRegulationsshallbeapplicabletobuildingofconstruction

projectshavingimpactsontheenvironmentwithintheterritoryofthePeople\'

sRepublicofChinaandotherterritorialseaareasunderthejurisdictionoft

hePeople\'sRepublicofChina.

Article3Statestandardsandlocalstandardsforthedischargeofpollutan

tsmustbecompliedwithinbuildingconstructionprojectsthatgeneratepollut

ion;requirementsforaggregatecontrolofdischargeofmajorpollutantsmustb

emetinareasunderaggregatecontrolofdischargeofmajorpollutants.

Article4Industrialconstructionprojectsshouldadoptcleanproductionte

chniqueswithlowenergyconsumption,lowmaterialsconsumptionandlowpolluta

ntsgeneration,rationallyexploitnaturalresourcestopreventenvironmentalp

ollutionandecologicaldamage.

Article5Measuresmustbetakeninreconstruction,expansionprojectsand

technologicaltransformationprojectstotreatoriginalenvironmentalpollution

andecologicaldamagerelatedtothesaidprojects.

ChapterIIEnvironmentalImpactEvaluation

Article6Thestatepractisestheconstructionprojectenvironmentalimpact

kofconstructionprojectenvironmentalimpactevalu

ationshallbeundertakenbyunitshavingacquiredcertificatesofcorrespondin

gqualifications.

Article7Thestatepractisesclassifiedcontroloverconstructionproject

environmentalprotectioninaccordancewiththeextentofenvironmentalimpact

ofconstructionprojectsinpursuanceofthefollowingprovisions:

(1)areportonenvironmentalimpactshouldbecompiledforaconstructionp

detailedevaluationofthepollutiongeneratedandenvironmentalimpactcaused

bytheconstructionproject;

(2)astatementonenvironmentalimpactshouldbecompiledforaconstructio

nprojectthatmaycauselightimpactontheenvironment,givinganalysisorsp

ecial-purposeevaluationofthepollutiongeneratedandenvironmentalimpactca

usedbytheconstructionproject;and

(3)aregistrationformshouldbefilledoutandsubmittedforaconstructio

nprojectthathasslightimpactontheenvironmentandnecessitatesnoenviron

mentalimpactevaluation.

Catalogfortheclassifiedcontrolofconstructionprojectenvironmentalpr

otectionshallbecompiledandpublishedbythecompetentdepartmentofenviron

mentalprotectionadministrationundertheStateCouncil.

Article8Thereportonconstructionprojectenvironmentalim

pactshouldcontainthefollowingcontents:

(1)anoverviewoftheconstructionproject;

(2)currentstateofenvironmentsurroundingtheconstructionproject;

(3)analysisandpredictionsofimpactswhichmaybecausedbytheconstruct

ionprojectontheenvironment;

(4)measuresforenvironmentalprotectionandtheirfinancialandtechnical

authentication;

(5)environmentalimpacteconomicloss-benefitanalysis;

(6)proposalsforenvironmentmonitoringoftheconstructionproject;and

(7)conclusionsoftheenvironmentalimpactevaluation.

Aschemeforwaterandsoilconservationexaminedandapprovedbythecompe

Contentsandformatsoftheconstructionprojectenvironmentalimpactstate

mentandenvironmentalimpactre

gistrationformshallbeprescribedbythecompetentdepartmentofenvironmenta

lprotectionundertheStateCouncil.

Article9Aconstructionunitshould,inthephaseofconstructionproject

feasibilitystudy,sumbittheconstructionprojectenvironmentalimpactreport,

environmentalimpactstatementorenvironmentalimpactregistrationformfora

pproval;however,forsuchconstructionprojectsasrailwaysandcommunications,

environmentalimpactreportorenvironmentalimpactstatementmay,priortoth

ecompletionofpreliminarydesign,besubmittedforapprovalupontheconsent

ofthecompetentdepartmentofenvironmentalprotectionadministrationwithaut

horityofexaminationandapproval.

Foraconstructionprojectthatnecessitatesnofeasibilitystudypursuant

torelevantstateprovisions,theconstructionunitshould,priortothestart

ofconstructionoftheconstructionproject,submittheconstructionprojecten

vironmentalimpactreport,environmentalimpactstatementorenvironmentalimpa

ctregistrationformforapproval;amongwhichwhereapplicationforabusiness

licenceisrequired,theconstructionunitshould,priortotheapplicationfo

rbusinesslicence,submittheconstructionprojectenvironmentalimpactreport,

environmentalimpactstatementorenvironmentalimpactregistrationformfora

pproval.

Article10Constructionprojectenvironmentalimpactreports,environmental

impactstatementsorenvironmentalimpactregistrationformsshallbesubmitte

dbyconstructionunitstocompetentdepartmentsofenvironmentalprotectionad

ministrationwithauthorityofexaminationandapprovalforexaminationandapp

roval;whereconstructionprojectshavecompetentdepartmentsoftrades,their

environmentalimpactreportsorenvironmentalimpactstatementsshould,uponpr

eliminaryexaminationofthecompetentdepartmentsoftrades,besubmittedtot

hecompetentdepartmentsofenvironmentalprotectionadministrationwithauthor

ityofexaminationandapprovalforexaminationandapproval.

Coastalengineeringconstructionprojectenvironmentalimpactreportorenv

ironmentalimpactstatementshall,upontheexaminationandv

erificationofthecompetentdepartmentofmaritimeadministrationwithviewsa

ttachedthereonto,besubmittedtothecompetentdepartmentofenvironmental

protectionadministrationforexaminationandapproval.

Competentdepartmentsofenvironmentalprotectionadministrationshould,wi

thin60daysstartingfromthedateofreceiptoftheconstructionprojectenvi

ronmentalimpactreport,within30daysstartingfromthedateofreceiptofth

eenvironmentalimpactstatementandwithin15daysstartingfromthedateofr

eceiptoftheenvironmentalimpactregistrationform,makeadecisiononexamin

ationandapprovalandnotifytheconstructionunitsinwritingrespectively.

Nofeewhatsoevershallbecollectedforthepreliminaryexamination,exami

nationandverification,andexaminationandapprovalofconstructionprojecte

nvironmentalimpactreports,environmentalimpactstatementsorenvironmentali

mpactregistrationforms.

Article11Thecompetentdepartmentofenvironmentalprotectionadministrat

ionundertheStateCouncilshallberesponsiblefortheexaminationandapprov

alofthefollowingconstructionprojectenvironmentalimpactreports,environm

entalimpactstatementsorenvironmentalimpactregistrationforms:

(1)special-natureconstructionprojectssuchasnuclearfacilitiesandtop-

secretprojects;

(2)constructionprojectstranscendingtheadministrativeareasoftheprovi

nces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernme

nt;and

(3)constructionprojectssubjecttotheexaminationandapprovaloftheSta

teCouncilortheexaminationandapprovalofthedepartmentsconcernedauthori

zedbytheStateCouncil.

Limitsofauthorityofexaminationandapprova

loftheconstructionprojectenvironmentalimpactreports,environmentalimpac

tstatementsorenvironmentalimpactregistrationformsbesidethoseprovidedf

orintheprecedingparagraphshallbeprescribedbypeople\'sgovernmentsofth

eprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralG

overnment.

Whereaconstructionprojectcausestrans-administrativeareaenvironmental

impactandadisputearisesbetweenthecompetentdepartmentsconcernedofenv

ironmentalprotectionadministrationovertheconclusionsofenvironmentalimpa

ctevaluation,theenvironmentalimpactreportorenvironmentalimpactstatemen

tshallbesubmittedtothejointcompetentdepartmentofenvironmentalprotect

ionadministrationatthenexthigherlevelforexaminationandapproval.

Article12Wheremajorchangestakeplaceinthenature,scale,locationor

productiontechniquesadoptedoftheconstructionprojectuponapprovalofthe

constructionprojectenvironmentalimpactreport,environmentalimpactstateme

ntorenvironmentalimpactregistrationform,theconstructionunitshouldonce

againsubmittheconstructionprojectenvironmentalimpactreport,environment

alimpactstatementorenvironmentalimpactregistrationformforapproval.

Whereaconstructionprojectstartsconstructiononexpiryof5yearsstartin

gfromthedateofapprovaloftheconstructionprojectenvironmentalimpactreport,envir

onmentalimpactstatementorenvironmentalimpactregistrationform,itsenvironmentalim

pactreport,environmentalimpactstatementorenvironmentalimpactregistrationformshou

ldbesubmittedtotheoriginalexaminationandapprovalorganforre-examinationandrev

ginalexaminationandapprovalorganshould,within10daysstartingfr

omthedateofreceiptoftheconstructionprojectenvironmentalimpactreport,en

vironmentalimpactstatementorenvironmentalimpactregistrationform,notify

theconstructionunitinwritingoftheviewsonexaminationandverification;

failuretonotifyonexpiryshallbeconstruedasapprovaluponexaminationand

verification.

Article13Thestatepractisesthequalificationexaminationsystemofunit

sengagingintheworkofconstructionprojectenvironmentalimpactevaluation.

Unitsengagingintheworkofconstructionprojectenvironmentalimpacteva

luationmustobtainaqualificationcertificateissuedbythecompetentdepartm

entofenvironmentalprotectionadministrationundertheStateCouncil,engage

intheworkofconstructionprojectenvironmentalimpactevaluationpursuantto

thegradeandscopeprescribedinthequalificationcertificate,andberespon

petentdepartmentofenvironmental

protectionadministrationundertheStateCouncilshouldpublishatregularin

tervalsthelistofunitsengagingintheworkofconstructionprojectenvironm

entalimpactevaluationwhichhavealreadybeenissuedqualificationcertificat

icmeasuresshallbeworkedoutbythecompetentdepartmentofenviro

nmentalprotectionadministrationundertheStateCouncil.

Unitsengagingintheworkofconstructionprojectenvironmentalimpacteva

luationmuststrictlycomplywiththeratesforthecollectionofchargespresc

ribedbythestate.

Article14Constructionunitsmayadopttheformofopentendertoselectt

heunitsengagingintheworkofenvironmentalimpactevaluationforenvironmen

talimpactevaluationoftheconstructionprojects.

Noadministrativeorganshallappointunitsengagingintheworkofenviron

mentalimpactevaluationforconstructionunitsforenvironmentalimpactevalua

tion.

Article15Constructionunitsshould,incompilingtheenvironmentalimpact

reports,solicittheviewsoftheunitsandresidentsconcernedofthelocalit

ywhereintheconstructionprojectislocatedpursuanttorelevantprovisionso

flaw.

hapterIIIConstructionofEnvironmentalProtectionFacilities

Article16Simultaneousdesign,simultaneousconstructionandsimultaneous

goingintooperationwiththemainbodyprojectmustberealizedformatch

ingenvironmentalprotectionfacilitiesconstructionwhichisrequiredforthe

constructionproject.

Article17Thepreliminarydesignofaconstructionprojectshould,pursuan

ttotherequirementsofenvironmentalprotectiondesignstandards,containcom

pilationofachapteronenvironmentalprotection,andascertainmeasuresfort

wellasbudgetaryestimateforinvestmentinthechapteronenvironmentalprot

ectiononthebasisoftheapprovedconstructionprojectenvironmentalimpactr

Article18Wheretrialproductionisrequireduponcompletionofthemainb

odyprojectofaconstructionproject,itsmatchingenvironmentalprotectionfa

cilitiesbuiltmustgointosimultaneoustrialrunwiththemainbodyproject.

Article19Theconstructionunitshould,duringthetrialproductionofac

onstructionproject,monitortheoperationsoftheenvironmentalprotectionfac

ilitiesandtheenvironmentalimpactoftheconstructionproject.

Article20Theconstructionunitshould,uponcompletionofaconstruction

project,fileanapplicationwiththecompetentdepartmentofenvironmentalpro

tectionadministrationthatexaminedandapprovedthesaidconstructionproject

environmentalimpactreport,environmentalimpactstatementorenvironmentali

mpactregistrationformforacceptancechecksoncompletionofmatchingconstru

ctionofenvironmentalprotectionfacilitiesrequiredforthesaidconstruction

project.

Acceptancechecksforcompletionofconstructionofenvironmentalprotectio

nfacilitiesshouldbeconductedsimultaneouslywiththeacceptancechecksfor

rialproductionis

onthsstartingfromthedateofthesaidconstructionprojectgoingintotrial

production,fileanapplicationwiththecompetentdepartmentofenvironmental

protectionadministrationthatexaminedandapprovedthesaidconstructionproj

ectenvironmentalimpactreport,environmentalimpactstatementorenvironmenta

limpactregistrationformforacceptancechecksoncompletionofmatchingcons

tructionofenvironmentalprotectionfacilitiesrequiredforthesaidconstruct

ionproject.

Article21Forconstructionprojectsthatarebuiltinphases,gointoprod

uctionoraredeliveredforuseinphases,acceptancechecksfortheircorrespo

ndingenvironmentalprotectionfacilitiesshouldbeconductedinphases.

Article22Competentdepartmentsofenvironmentalprotectionadministration

should,within30daysstartingfromthedateofreceiptoftheapplicationfo

racceptancechecksoncompletionofconstructionoftheenvironmentalprotecti

onfacilities,completetheacceptancechecks.

Article23Thesaidconstructionprojectmayonlyformallygointoproducti

onorbedeliveredforusewhenthematchingconstructionoftheenvironmental

protectionfacilitiesrequiredfortheconstructionprojecthaspassedacceptan

cechecks.

ChapterIVLegalLiability

Article24Whoevercommitsanyofthefollowingactsinviolationofthepr

ovisionsoftheseRegulationsshallbeorderedbythecompetentdepartmentofe

nvironmentalprotectionadministrationresponsiblefortheexaminationandappr

ovaloftheconstructionprojectenvironmentalimpactreport,environmentalimp

actstatementorenvironmentalimpactregistrationformtomakeuptheformalit

ieswithinagiventimeperiod;whoeverfailstomakeuptheformalitiesonexp

iryofthegiventimeperiodandstartconstructionwithoutauthorizationshall

beord

eredtostoptheconstructionandmaybeimposedafineoflessthanRMB100000

Yuan:

(1)failuretofileanapplicationforapprovaloftheconstructionproject

environmentalimpactreport,environmentalimpactstatementorenvironmentalim

pactregistrationform;

(2)failuretofileanewapplicationforapprovaloftheconstructionproje

ctenvironmentalimpactreport,environmentalimpactstatementorenvironmental

impactregistrationformintheeventofmajorchangestakingplaceinthenat

ure,scale,locationorproductiontechniquesadoptedoftheconstructionproje

ct;and

(3)failuretosubmittheconstructionprojectenvironmentalimpactreport,

environmentalimpactstatementorenvironmentalimpactregistrationformtothe

originalexaminationandapprovalorganforre-examinationandre-verification

oftheconstructionprojectthatstartsconstructiononexpiryof5yearsstar

tingfromthedateofapprovaloftheconstructionprojectenvironmentalimpact

report,environmentalimpactstatementorenvironmentalimpactregistrationfo

rm.

Article25Whoeverstartsconstructionwithoutauthorization,withoutthea

pprovaloftheconstructionprojectenvironmentalimpactreport,environmental

impactstatementorenvironmentalimpactregistrationformorwithouttheconse

ntuponre-examinationandre-verificationoftheoriginalexaminationandappr

ovalorganshallbeorderedbythecompetentdepartmentofenvironmentalprotec

tionadministrationresponsiblefortheexaminationandapprovalofthesaidco

nstructionprojectenvironmentalimpactreport,environmentalimpactstatement

orenvironmentalimpactregistrationformtostoptheconstruction,restorethe

originalstatewithinthegiventimeperiod,andmaybeimposedafineofless

thanRMB100000Yuan.

Article26Thematchingenvironmentalprotectionfacilitesbuiltfortheco

nstructionprojectthatgoesintotrialproductionfailtogointotrialrunsi

multaneouslywiththemainbodyprojectinviolationoftheprovisionsofthese

Regulationsshallbeorderedbythecompetentdepartmentofenvironmentalprot

ectionadministrationresponsiblefortheexaminationandapprovalofthesaid

constructionprojectenvironmentalimpactreport,environmentalimpactstatemen

torenvironmentalimpactregistrationformtomakearectificationwithinthe

giventimeperiod;whoeverfailstomakearectificationonexpiryofthegiven

timeperiodshallbeorderedtostopthetrialproduction,andmaybeimposed

afineoflessth

anRMB50000Yuan.

Article27Aconstructionunitthatfailstofileanapplicationforaccept

ancechecksoncompletionofconstructionoftheenvironmentalprotectionfacil

itiesofaconstructionprojecthavinggoneintotrialproductionformorethan

3monthsinviolationoftheprovisionsoftheseRegulationsshallbeordered

bythecompetentdepartmentofenvironmentalprotectionadministrationthatexa

minedandapprovedthesaidconstructionprojectenvironmentalimpactreport,e

nvironmentalimpactstatementorenvironmentalimpactregistrationformtogot

hroughtheformalitiesofacceptancechecksoncompletionoftheenvironmental

protectionfacilitieswithinthegiventimeperiod;whoeverfailstocompletet

hesaidformalitiesshallbeorderedtostopthetrialproductionandmaybeim

posedafineoflessthanRMB50000Yuan.

Article28Wherethemainbodyprojectformallygoesintoproductionoris

Article29Anyunitengagingintheworkofconstructionprojectenvironmen

talimpactevaluationthatpractisesfraudintheworkofenvironmentalimpact

evaluationshallberevokedofitsqualificationcertificatebythecompetentd

epartmentofenvironmentalprotectionadministrationundertheStateCouncil,a

ndmayconcurrentlybeimposedafineofmorethan100%lessthan300%ofthef

eecollected.

Article30Anyfunctionaryofthecompetentdepartmentofenvironmentalpro

tectionadministrationwhoindulgesinmalpracticesforselfishgains,abuseof

power,negligenceofdutythatconstituteacrimeshallbeinvestigatedofthe

criminalliabilityaccordingtolaw;whereacrimehasnotbeenconstituted,a

dministrativesanctionsshallbeimposedaccordingtolaw.

ChapterVSupplementaryProvisions

Article31Environmentalimpactevaluationshouldbedoneincompilingcons

tructionplanningforsuchregionaldevelopmentasvalleydevelopment,developm

entzoneconstruction,newurbandistrictconstructionandoldurbandistrictr

icmeasuresshallbeworkedoutseparatelybythecompeten

tdepartmentofenvironmentalprotectionadministrationundertheStateCouncil

inconjunctionwiththecompetentdepartmentsconcernedun

dertheStateCouncil.

Article32Environmentalprotectionadministrationofoffshoreoilprospect

ingandexploitationconstructionprojectsshallabidebytheprovisionsofthe

StateCouncilconcerningenvironmentalprotectionadministrationofoffshoreo

ilprospectingandexploitation.

Article33Environmentalprotectionadministrationofconstructionprojects

ofmilitaryinstallationsshallabidebytherelevantprovisionsoftheCentra

lMilitaryCommission.

Article34TheseRegulationscomeintoforceasofthedateofpromulgation
